Topsy Turvy Terms & Conditions

Notice of Cottage Food Operation: All foods prepared by Topsy Turvy Cakes & Accessories, LLC are made in a cottage food operation that is not subject to Florida’s commercial food safety regulations.
Ingredients: Our products may contain or come into contact with milk, wheat, nuts, soy, and other allergens. You agree to hold Topsy Turvy Cakes & Accessories, LLC harmless for allergic reactions and notify your guests of this risk.
Deposit: All products are custom-made to order. Your initial deposit reserves your event date and is non-refundable.
Payment: Your final payment is due on the final date for any changes in size, style, or flavor of the cake. Any changes requested after this date cannot be guaranteed and may be subject to additional charges. We must receive the balance by the due date indicated or the contract is null and void. Your deposit will not be refunded.
Customer Pick-Up: If you or your representative elect to pick up and set up the cake, you assume all liability and responsibility for the condition of the cake, once it leaves Topsy Turvy Cakes’ possession. Our layer cakes are heavy and require a sturdy table. The optimal room temperature should be 75 degrees or below. The customer is responsible for providing a sturdy table and optimal room temperature for the cake(s).
Delivery: Delivery is available upon request. A minimum order of $500 is required for delivery. Setup is $100 additional.
Additional Equipment: If your cake requires equipment such as columns, cake plates or a stand, a security deposit must be left with us at the time of final payment in order to ensure the safe return of the equipment. We will return this security deposit when the equipment is returned to us in original condition no later than 1 week past the event date. The security deposit is forfeited if the equipment is not returned within 2 days after the event.
Flowers: If flowers are provided by an outside source, we will arrange up to 25 stems free; $1 for each additional stem. You acknowledge that fresh flowers are not a food product, and may contain pesticides, insects, dirt, or other contaminants. You agree to notify your guests of this risk and hold Topsy Turvy Cakes & Accessories, LLC harmless for allergic reactions.
Photography: On occasion, we photograph our cakes and we reserve the right to use any photographs for display or promotion without compensation to you.
Performance of this agreement is contingent upon the ability of Topsy Turvy Cakes & Accessories, LLC to complete the agreement, and is subject to labor disputes or strikes, accidents, Acts of God, and other causes beyond our control. Deposits will be refunded if Topsy Turvy Cakes is unable to complete your order.
Refund Policy
No Refunds, once the order for food product is placed.
